Helping You & Your Family Plan for the Future

Planning for the future can be scary. Let our estate planning professionals help put your mind at ease.

No one wants to think about estate planning and the day they leave their loved ones behind. However, effective estate planning can help bring some comfort to you and your family. Our estate planning packages include durable and healthcare powers of attorney, last wills and testaments, living wills, and trust documents. All of these are essential to making sure your family is cared for when you are no longer around, and that your wishes are carried out upon your incapacitation and/or death.

At Rech Law, we can help you plan for the future ahead. Schedule an estate planning consultation with one of our attorneys today by calling (704) 659-0007.

Powers of Attorney

A power of attorney is a formal method of creating relationships under which one person has the ability to permanently or temporarily act in the place of another. While the name may suggest that you must be an attorney to assume such a relationship, this is not the case. Any competent individual may be a power of attorney for someone else.

At Rech Law, our estate planning attorneys in Charlotte can prepare three types of powers of attorney for your needs:

  • Healthcare Power of Attorney: A healthcare power of attorney is a legal document that typically works in concurrence with a living will. By executing a healthcare power of attorney you are authorizing another to make medical decisions for you should you be unable to make those decisions for yourself. We recommend that when designating someone to be your healthcare power attorney, or healthcare agent, that you not only choose someone close to you whom you trust but that you also discuss with them your wishes in the event of your incapacitation.
  • Durable Power of Attorney: Also known as a financial power of attorney, a durable power of attorney is a legal document that allows another person to make financial decisions on your behalf. Having a durable power of attorney is important because without one and in the event of your incapacitation the Court would need to appoint a guardian to handle your finances. This can be hard and costly for a family to bear.
  • Parental Power of Attorney: If the parent or parents of a minor are unable to care for the child as a result of serious illness, military deployment, or being unavailable for a period of time. This allows for the person granted power, usually a close relative, to make specific decisions regarding the minor’s healthcare, schooling, and other activities.

Our attorneys regularly help clients draft the following types of estate planning documents:

Wills. Having a last will and testament, as well as a living will, is vital if you want to safeguard your legacy with a comprehensive estate plan. Wills contain plans for healthcare, durable, and parental power of attorney. Additionally, a last will and testament can define how you'd like the property you own to be distributed to any beneficiaries once you pass away, and provide an executor or personal representative with other directives for ensuring your last wishes are honored during the probate process.

Trusts. Unbeknownst to many, property awarded through a trust bypasses the probate process, making trusts an invaluable way to distribute property among beneficiaries. Whether you want to develop a revocable or irrevocable trust, our Charlotte estate planning lawyers will work with you to ensure your property is handled correctly and you develop a comprehensive trust that meets your needs.

Preparing for the end of your life can be daunting, so do it with a legal representative you can trust to respect your wishes and guide you through the process with sound, compassionate counsel. Our Charlotte estate planning lawyers will do whatever it takes to make the estate planning process streamlined and easily navigable for you.

At Rech Law, we can help you designate a power of attorney that makes you feel comfortable. Contact us at (704) 659-0007 to learn more.
